Terms of Use

1. Agreement

These Terms of Use (“Terms”) are a contract between you and Jungean-Herman Marius-Alexandru, acting as Alexandru Jungean (“we”, “us”), for the information-society service Internet Speed Test at https://speed.alexjungean.com (the “Service”).

By accessing or using the Service you agree to these Terms and to the Privacy Policy and Cookie Policy. If you do not agree, do not use the Service.

If you are a consumer in the European Union, the European Economic Area, or another jurisdiction that grants mandatory consumer protections, those protections apply and prevail over any clause that would restrict them.

2. Operator

The Service is provided by Jungean-Herman Marius-Alexandru, a natural person established in Romania. Contact: alex.jungean@gmail.com. Full identification duties are set out in the Legal Notice.

3. The Service

The Service is a free, one-action browser speed test. Start measures download throughput (scored 25 MiB after warmup), upload throughput (1 MiB POSTs, 48 MiB or 8 s), and HTTP round-trip latency to one Cloudflare Worker at https://speed-measure.alexandrujungean.workers.dev. Numbers are browser measurements in Mbps and ms, labelled with the edge colo when the Worker provides it. The smaller upload stays on Workers Free (10 ms CPU).

• There are no accounts, saved history, or server-side result stores.
• Throughput does not run inside a Netlify Function.
• The Worker is not an open proxy and ignores any URL you might send.
• Tests are rate-limited (hashed IP, daily and burst caps, duration and byte caps).
• A second Start replaces the previous numbers. Runs are not averaged.

4. Eligibility

You must be at least 16 years old, or you must use the Service only with the authorisation of a parent or guardian where that is required. You must have the legal capacity to agree to these Terms.

5. Licence to use the Service

We grant you a personal, revocable, non-exclusive, non-transferable right to use the public Service for a personal speed check, for lawful purposes, in accordance with these Terms.

This licence does not give you the right to:

• copy, republish, or frame the Service as your own product;
• use the Service as a bandwidth weapon, open proxy, or persistent firehose;
• scrape, overload, or probe the hosting or measurement infrastructure beyond ordinary use;
• bypass rate limits, session tokens, or duration/byte caps;
• use our name or the product name to imply certification, partnership, or endorsement.

The source repository is proprietary. Public use of the website is not an open-source grant.

6. Acceptable use

You may not:

• run automated or unbounded tests that degrade the Service for others;
• treat the measurement host as a general-purpose download or upload proxy;
• introduce malware or use the Service as a delivery path for malware;
• misrepresent the Service as certified, official, multi-server, or an ISP-lab result;
• send unlawful content to the contact email.

7. Intellectual property

The Service, the name “Internet Speed Test”, the public interface, the documentation, and the underlying software are proprietary to Jungean-Herman Marius-Alexandru unless a third-party licence says otherwise. Self-hosted fonts are used under their own licences (Clash Display under the Fontshare EULA; Inter under its published licence).

8. Privacy

Personal data is described in the Privacy Policy. Cookies and similar technologies are described in the Cookie Policy. Those documents form part of these Terms.

9. Disclaimers

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

In particular, we do not warrant that:

• the Service will be uninterrupted, error-free, or available in every browser;
• Mbps or ms will match another tool, your ISP’s claim, or a certified lab;
• a single-stream test will saturate a multi-gigabit path;
• the nearest Cloudflare edge represents your ISP’s peering to every destination.

Consumers keep every statutory guarantee that cannot be excluded.

10. Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, business interruption, or substitute services, arising from the Service or from these Terms.

If we are liable despite the previous paragraph, our aggregate liability for all claims arising out of the Service is limited to the greater of (a) the amount you paid us for the Service in the twelve months before the claim (currently zero, because the Service is free) and (b) EUR 0, except where a higher minimum is mandatory.

Nothing in these Terms excludes or limits liability for:

• intent (dol) or, where mandatory, gross negligence;
• death or personal injury caused by negligence;
• fraud or fraudulent misrepresentation;
• any liability that Romanian law or EU consumer law does not allow to be limited.

11. Changes and availability

We may modify, suspend, or discontinue the Service at any time, including changing caps, the measurement host, or published routes. We may update these Terms by posting a new version on this page with a new effective date.

12. Governing law and disputes

These Terms are governed by Romanian law, excluding conflict-of-law rules that would point to another law, without prejudice to mandatory consumer protections of your country of habitual residence in the EU/EEA.
